1. Agreement
These Terms of Service ("Terms") are an agreement between you and Jump In Adventures ("Jump In Adventures," "we," "us"). They apply when you use jumpinadventures.com (the "Site") and when you request or book any of our services. By using the Site or booking with us, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site or our services. You must be at least 18 to book.
2. Our services
We plan, organize and deliver adventure experiences, including skydiving, skydiving shows and brand jumps for events, private expeditions, helicopter and balloon flights, paragliding, diving and turnkey skydiving operations ("Services"). Some Services are delivered by our own team and some by trusted independent partners, such as aircraft operators, instructors, guides, hotels and transport companies. Your booking confirmation states who provides each part of your trip. Partners' own terms may also apply to the parts they provide.
Destination pages on the Site describe ideas and possibilities. They are not a promise that a particular activity is available at a particular time; availability depends on season, weather, permits, local law and safety conditions.
3. Quotes, bookings and payment
Information on the Site is not an offer. A booking is confirmed only when we confirm it in writing and receive any required deposit. Your booking agreement or confirmation sets out the price, what is included, payment dates, and our change, cancellation and refund terms; if it conflicts with these Terms, the booking agreement controls for that booking. Where California Seller of Travel law applies, we will provide the disclosures it requires in your booking documents.
4. Adventure activities and risk
Skydiving, aviation, ballooning, paragliding, diving, mountain travel and other adventure activities carry inherent risks, including serious injury and death, that cannot be completely removed even when everyone takes great care. Before you take part, you will be asked to sign a participation agreement, release or waiver for the activity, to meet its age, weight, health and fitness requirements, and to follow your instructors' and guides' directions at all times. You agree to tell us truthfully about any medical condition or other factor that could affect your safety. We, our instructors and our partners may refuse or stop your participation at any time for safety reasons.
5. Weather, safety and changes
Adventure activities depend on weather, airspace, permits, equipment and local conditions. We may delay, reschedule, change or cancel an activity, route or show when we believe safety requires it, or when events beyond our reasonable control (such as weather, government action, natural disasters or unrest) prevent it. What happens to your booking in those cases is set out in your booking agreement.
6. Your travel responsibilities
You are responsible for having valid passports, visas, vaccinations and other documents needed for your trip, and for checking official travel advisories. We strongly recommend travel insurance that covers adventure activities, medical evacuation and cancellation.
7. Using this website
- You may use the Site for personal, lawful purposes. Don't misuse it, interfere with it, try to access it without authorization, or use it to send spam or harmful code.
- The Site's content, design, text, graphics and logos belong to us or our licensors and are protected by intellectual property laws. You may not copy or reuse them for commercial purposes without our permission.
- When you send us information through the Site, you confirm it is accurate and that you have the right to share it, and you allow us to use it to respond to you and provide our Services.
- The Site may link to other websites. We are not responsible for their content or practices.
8. Disclaimers
The Site and its content are provided "as is" and "as available." Destination information is general and may change; always check current conditions and official advisories. To the fullest extent permitted by law, we disclaim all warranties about the Site, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising from your use of the Site. For the Services, our liability is limited as set out in your booking agreement and participation agreements. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, gross negligence or willful misconduct, or any rights you have under California law that cannot be waived.
10. Indemnity
You agree to indemnify and hold us harmless from claims arising from your misuse of the Site, your breach of these Terms, or your violation of any law or the rights of others, to the extent permitted by law.
11. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Site will be resolved in the state or federal courts located in California, and you and we consent to their jurisdiction. Before filing a claim, please contact us so we can try to resolve the issue informally.
12. General
We may update these Terms by posting a new version on this page with a new effective date; changes don't affect bookings already confirmed. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These Terms, together with your booking documents, are the entire agreement between us about their subject matter.
